GENERAL TERMS AND CONDITIONS
1. Definitions
1.1 In these General Terms and Conditions, the following terms (both singular and plural) have the following meanings:
- “General Terms and Conditions”: The General Terms and Conditions of Friends Concept;
- “Event”: Any public or private event organized by Friends Concept;
- “Location”: The place where the event is held, typically in bars, clubs, or outdoor venues in France;
- “Organizer”: Friends Concept, responsible for the production and/or organization of the event;
- “Agreement”: The agreement between Friends Concept and the consumer for the sale and delivery of tickets;
- “Ticket”: Proof of access to an event, typically delivered as a digital QR code.
2. Applicability
2.1 The General Terms and Conditions outlined below apply to all offers, orders, and agreements made by Friends Concept.
2.2 By accepting an offer or placing an order, the consumer expressly accepts the applicability of these General Terms and Conditions.
2.3 Deviations from the stipulations in these General Terms and Conditions are only possible in writing, in which case all other provisions will remain in full force.
2.4 All rights and entitlements stipulated for Friends Concept in these General Terms and Conditions and any further agreements will also apply to intermediaries and other third parties deployed by Friends Concept.
3. Prices/Offers
3.1 All offers made by Friends Concept are without obligation, and Friends Concept reserves the right to change prices, particularly in response to statutory or other regulations.
3.2 All prices are indicated in euros, inclusive of VAT.
3.3 Promotional prices may apply for specific periods. These prices are valid during the specified period as long as availability lasts. No rights may be derived from promotional prices outside of the specific promotional period.
3.4 Friends Concept is not bound to any price indications that are clearly incorrect due to typographical or printing errors. No rights can be derived from incorrect pricing information.
3.5 A fixed service fee may be charged for each ticket, which varies according to the event. Service fees include transaction, consultation, and delivery costs.
4. Cancellations and Returns
4.1 The Organizer reserves the right to cancel or reschedule an event. In such cases, Friends Concept will strive to offer a suitable solution. If an event is canceled or postponed, Friends Concept will make every effort to inform the consumer as soon as possible. However, we cannot guarantee that the consumer will be informed before the event begins, and Friends Concept will not be liable for any resulting costs.
4.2 Consumers must verify their bookings carefully before confirming. No refunds will be issued for cancellations made within 48 hours of the event. Cancellations made more than 48 hours before the event will be refunded 70% of the ticket price.
5. Payments
5.1 Friends Concept accepts payments in euros via credit card or cash for special events. A booking is not confirmed until payment is successfully processed.
6. Delivery
6.1 Tickets will be delivered to the email address provided by the consumer during the booking process, typically as a QR code.
6.2 The delivery times specified by Friends Concept are indicative. Failure to meet the delivery deadline does not entitle the consumer to any form of compensation, nor does it entitle them to cancel the order or dissolve the agreement unless the delay is unreasonable.
7. Retention of Title
7.1 Ownership of the tickets is transferred to the consumer only after all obligations to Friends Concept have been fulfilled. The risk of the tickets is transferred to the consumer upon delivery.
8. Complaints and Liability
8.1 Consumers are required to check that tickets comply with the agreement upon delivery. If tickets do not meet the agreement, consumers must inform Friends Concept in writing within five (5) days of delivery, provided it was reasonably possible to ascertain the discrepancy.
8.2 If it is proven that the tickets do not meet the agreement, Friends Concept may choose to replace the tickets or refund the purchase amount.
9. Electronic Communication and Evidence
9.1 Friends Concept is not liable for any misunderstandings, distortions, delays, or incorrect transmission of data and messages due to the use of the internet or other communication resources between the consumer and Friends Concept.
9.2 The records of Friends Concept will serve as full evidence of the existence, content, and implementation of the agreement with the consumer, subject to counter-evidence provided by the consumer.
10. Force Majeure
10.1 In the event of force majeure, Friends Concept is entitled to suspend the fulfillment of the order or dissolve the agreement without legal intervention by informing the consumer in writing. Friends Concept will not be liable for any damage compensation unless it would be unreasonable to do so under the prevailing circumstances.
10.2 Force majeure includes any shortcoming that cannot be attributed to Friends Concept due to reasons beyond its control, such as natural disasters, strikes, or government actions.
11. Special Provisions, Liability
11.1 Ticket purchasers must behave responsibly during events and follow instructions from the event organizer and relevant authorities.
11.2 Friends Concept is not liable for any refusal of entry by the organizer or authorities due to the actions or negligence of the ticket purchaser.
11.3 Ticket purchasers attend events at their own risk. Friends Concept is not liable for any damage incurred by the purchaser during travel to and from the event or while attending the event.
11.4 Ticket purchasers are responsible for familiarizing themselves with any instructions issued by the organizer or relevant authorities, including any changes to the event.
12. Photo/Video Disclaimer
12.1 By participating in any Friends Concept event, you agree to grant Friends Concept the irrevocable right to use any photographs, videos, or other media captured during the event for promotional purposes, including publications, websites, social media, and promotional materials.
12.2 If you prefer not to have your image used for promotional purposes, you must notify the photographer or event organizers in writing before the event or contact Friends Concept at [insert email] with your request and a photograph.
12.3 By participating in an event or by not notifying Friends Concept in writing that you do not wish to be photographed, you consent to the use of your voice, name, and likeness for media exploitation without compensation.
12.4 External parties not affiliated with Friends Concept are prohibited from using, copying, altering, or modifying event photographs, graphics, videos, or other reproductions without obtaining advance written permission from an authorized representative of Friends Concept.
13. Governing Law and Jurisdiction
13.1 French law applies to all agreements entered into with or concluded by Friends Concept. Disputes arising directly or indirectly from these agreements will be exclusively settled by the Court of Paris.
